Terms and Conditions
These Terms and Conditions (“Terms”) govern your access to and use of the Screenwell website at https://screenwell.ai, the Screenwell web application and the AI interviewer Luna (together, the “Services”), provided by Screenwell.ai (“Screenwell”, “we”, “us”, “our”).
Screenwell.ai is operated by Ninja Devs d.o.o. Tuzla, Trg Slobode 16, 75000 Tuzla, Bosnia and Herzegovina (JIB 4210641730008, MBS 32-01-0063-25).
By creating an account, starting a free trial or otherwise using the Services, you agree to these Terms on behalf of yourself and the organisation you represent (“you”, “Customer”). If you do not agree, do not use the Services.
1. Definitions
- Customer: the organisation, or the person acting for it, that holds a Screenwell account and uses the Services to interview candidates.
- Candidate: a person who is interviewed through the Services at the Customer’s request.
- Luna: the Screenwell AI interviewer, including its voice, video avatar and conversational features.
- Interview: a conversation conducted by Luna, whether in a Google Meet or Microsoft Teams call or through a Screenwell interview link.
- Customer Content: material the Customer provides to the Services, such as job descriptions, questions, scoring criteria, company decks, product or portfolio material and tests.
- Interview Data: data created in an Interview, such as audio and video recordings, transcripts, test answers, scores, scorecards and recommendations.
2. Eligibility and accounts
- The Services are intended for business use. You must be at least 18 years old and authorised to bind the organisation on whose behalf you use them.
- You must provide accurate account information and keep it up to date.
- You are responsible for keeping your login credentials confidential and for all activity under your account. Tell us immediately at info@screenwell.ai if you suspect unauthorised use.
- You may invite team members to your account. You are responsible for their compliance with these Terms.
3. The Services
Screenwell lets you run first-round interviews with Luna. Depending on your plan, Luna can join Google Meet and Microsoft Teams calls, interview candidates through a public interview link, introduce your company, talk candidates through your product or portfolio material, ask screening and technical questions, set timed tests, and deliver transcripts, recordings and scorecards to your dashboard.
We continuously improve the Services and may add, change or remove features. If we remove a feature that is material to a paid plan you are subscribed to, we will give you reasonable notice.
4. Free use, plans and pricing
- Free start: You can create an account and try the Services for free within the limits shown in the application or on our pricing information.
- Paid plans: Additional use is available through paid subscriptions or usage-based packages. Current prices, included interviews or credits and plan limits are shown in the application before you buy.
- Fair use: Plans are subject to their stated limits. We may restrict use that clearly exceeds them or that harms the stability of the Services.
5. Payment and billing
- Payment processor: Payments are processed by Lemon Squeezy, our reseller and merchant of record. By providing payment details you authorise us, through Lemon Squeezy, to charge the applicable fees.
- Renewal: Subscriptions renew automatically at the end of each billing period unless you cancel before the renewal date in your account settings or by contacting us.
- Taxes: Prices exclude taxes unless stated otherwise. You are responsible for any taxes that apply to your purchase.
- Refunds: Fees are non-refundable except where required by law or agreed with us in writing. Unused credits or interviews do not carry over after cancellation unless your plan says otherwise.
- Price changes: We may change prices for future billing periods. We will inform you in advance, and the change takes effect at your next renewal.
6. Your responsibilities towards candidates
You decide whom to interview, what Luna asks and how the results are used. You therefore remain responsible for your recruitment process and agree to:
- tell candidates before or at the start of the Interview that they will be interviewed by an AI interviewer, that the Interview is recorded and transcribed, and how their data will be used;
- have a valid legal basis for processing candidate data and obtain consent where the law requires it;
- use only lawful, job-related questions, criteria and tests, and never ask about or score candidates on protected characteristics such as age, gender, ethnicity, religion, disability or sexual orientation;
- have a person review Interview Data before making a hiring decision, and not use Screenwell as the sole basis for decisions that legally or significantly affect a candidate where the law requires human involvement;
- offer reasonable adjustments or an alternative interview format to candidates who ask for one;
- respond to candidates’ requests about their data. We will support you as described in our Privacy Policy and data processing terms.
7. Customer Content and Interview Data
- Ownership: You retain all rights in your Customer Content and in the Interview Data generated for you.
- Licence to us: You grant us a non-exclusive, worldwide licence to host, process, display and transmit Customer Content and Interview Data solely to provide, secure and support the Services for you.
- Service improvement: We may use aggregated, de-identified information about how the Services perform to improve them. We do not use your Customer Content or identifiable Interview Data to train general-purpose AI models.
- Your warranty: You confirm that you have the rights needed to provide your Customer Content, including any material Luna talks candidates through, and that it does not infringe anyone else’s rights.
8. Data protection
For candidate data processed through the Services, you act as the controller and we act as your processor. Our processing of that data is governed by our data processing terms, which form part of these Terms and are available on request at info@screenwell.ai. How we handle personal data for our own purposes is described in our Privacy Policy.
9. AI output
Luna’s questions, transcripts, scores and recommendations are generated with artificial intelligence. They can contain mistakes, and speech recognition and translation may be imperfect, especially with background noise or poor connections. Interview Data is provided to support your decisions, not to make them. You are responsible for reviewing it before relying on it.
10. Third-party platforms
When Luna joins a Google Meet or Microsoft Teams call, your use of those platforms is also subject to the terms of Google or Microsoft. Parts of the Services, such as speech recognition, speech synthesis, language models and video avatars, are provided with the help of third-party technology providers. We are not responsible for outages or changes of third-party platforms outside our reasonable control.
11. Acceptable use
You must not, and must not allow anyone to:
- use the Services for any unlawful, discriminatory or deceptive purpose, including misleading candidates about who is interviewing them or about the job;
- use Luna, her voice or her likeness to impersonate a real person, or present Interviews as being conducted by a human;
- record or process people who have not been properly informed, or use the Services for surveillance unrelated to recruitment;
- upload malicious code, attempt to gain unauthorised access, or interfere with the security or performance of the Services;
- reverse engineer, copy or resell the Services, or use them to build a competing product;
- scrape, mine or extract data from the Services by automated means other than through features we provide.
We may suspend access that violates this section, where possible after notifying you.
12. Intellectual property
The Services, including the software, Luna, the Screenwell name and logo, designs and documentation, are owned by us or our licensors and are protected by intellectual property laws. Except for the right to use the Services under these Terms, no rights are transferred to you. Feedback you send us may be used freely to improve the Services.
13. Confidentiality
Each party will keep the other’s non-public information confidential and use it only to perform under these Terms, except where disclosure is required by law. This duty continues after the Terms end.
14. Disclaimer of warranties
We provide the Services with reasonable care and skill. Beyond that, and to the extent permitted by law, the Services are provided “as is” and “as available”, and we disclaim all other warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that the Services will be uninterrupted or error-free, or that any candidate you interview will be suitable or successful.
15. Limitation of liability
- To the extent permitted by law, neither party is liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data or goodwill.
- Our total liability arising from or relating to the Services is limited to the fees you paid us in the twelve (12) months before the event giving rise to the claim.
- These limitations do not apply to liability that cannot be limited by law, such as liability for intent, gross negligence or death and personal injury.
16. Indemnification
You will defend and indemnify us against third-party claims, including claims by candidates or authorities, that arise from your Customer Content, your recruitment decisions, or your breach of these Terms or applicable law, and you will cover the reasonable costs and damages resulting from them.
17. Term and termination
- By you: You can cancel your subscription at any time in your account settings; it ends at the close of the current billing period. You can close your account by contacting us.
- By us: We may suspend or terminate your access if you materially breach these Terms, fail to pay, or if required by law. Where reasonable, we will notify you first and give you a chance to fix the issue.
- Your data: After termination you have 30 days to export your Interview Data. After that we delete it, unless we are legally required to keep it.
- Sections that by their nature should survive termination, such as payment obligations, confidentiality, liability and indemnification, continue to apply.
18. Changes to these Terms
We may update these Terms. We will notify you of material changes by email or in the application at least 30 days before they take effect. If you continue to use the Services after that date, the updated Terms apply. If you do not agree, you may cancel before the change takes effect.
19. Governing law and disputes
These Terms are governed by the laws of Bosnia and Herzegovina, without regard to its conflict-of-law rules. The competent courts of Bosnia and Herzegovina have jurisdiction over any dispute, unless mandatory law provides otherwise. We will always try to resolve concerns informally first, so please contact us before starting proceedings.
20. General
- If a provision of these Terms is found invalid, the rest remains in force.
- Our failure to enforce a provision is not a waiver of it.
- You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition or sale of assets.
- These Terms, together with any order form, our data processing terms and our Privacy Policy, are the entire agreement between you and us about the Services.
